MahaRERA Highlights Alarming Non-Compliance Across Multiple Housing Projects

The Maharashtra Real Estate Regulatory Authority (MahaRERA) has raised red flags regarding 212 housing projects that launched between January and April 2023. These projects, which have failed to provide mandatory construction updates, are in violation of regulations and have prompted MahaRERA to take serious action.

Lack of Construction Updates Poses Risks to Homebuyers

MahaRERA has expressed concern for homebuyers, particularly in light of the fact that developers of these projects have not submitted their Quarterly Progress Reports (QPRs) as required. Without these updates, homebuyers are left in the dark regarding the status of construction and the progress of their potential homes.

To warn the public, MahaRERA has published a district-wise list of the projects that are non-compliant. Pune city leads the chart with 47 such projects, while Nashik and Palghar each account for 23. Other districts, including Thane, Raigad, Sambhaji Nagar, and Nagpur, also have multiple projects that have failed to provide updates.

Regions Most Affected by Non-Compliance

The Mumbai Metropolitan Region (MMR) and the Konkan region are home to the highest number of non-compliant projects, with a total of 76 projects that have failed to provide updates. Pune follows closely with 64 projects, while North Maharashtra, Vidarbha, and Marathwada regions also face significant non-compliance issues.

Developers' Obligation to Provide Regular Updates

Under MahaRERA regulations, developers are required to submit specific forms detailing their project's progress on a quarterly and annual basis. This transparency is key to safeguarding homebuyers' interests and ensuring that construction milestones are met. However, of the 2,369 projects registered with MahaRERA between January and April 2023, an alarming 886 projects have not provided the required QPRs.

Consequently, MahaRERA has issued notices under the Real Estate Regulation and Development Act, 2016, giving developers a 30-day window to rectify their non-compliance. If they fail to comply, MahaRERA has the authority to suspend the projects, freeze their bank accounts, and halt all transactions related to the projects.

Financial Penalties and MahaRERA's Enforcement Actions

In addition to issuing notices, MahaRERA has sent reminders and imposed penalties on 672 non-compliant projects. Shockingly, even after paying penalties, 244 projects have continued to withhold their Quarterly Progress Reports. MahaRERA remains actively engaged in ensuring that these projects update their statuses to protect homebuyers and maintain transparency in the real estate sector.

Developers’ Non-Responsive Behavior

The 212 projects that have consistently ignored MahaRERA’s communication attempts were registered in different months: 60 projects in January 2023, 58 in February 2023, 40 in March 2023, and 56 in April 2023. Developers must realize that compliance with MahaRERA regulations is not optional but essential. Accurate and timely project updates allow homebuyers to make well-informed decisions about their investments and financial commitments.
