Why is Uttarakhand Introducing Stricter Land Laws?

The influx of outsiders purchasing land in Uttarakhand’s hill regions has prompted the state government to take action. With the current regulations allowing individuals to buy up to 250 square meters of land for personal use in non-municipal areas, many buyers have found ways to bypass the law.

This has led to concerns about the exploitation of the state’s natural resources and the uncontrolled accumulation of land by individuals from other states. The government is now looking to enforce stricter measures to protect local interests and prevent illegal acquisitions.

How Will the New Land Purchase Laws Be Enforced?

Introduction of a Stringent Law: The Uttarakhand government plans to introduce a “stringent land purchase law” during the next budget session of the assembly.

Identifying Violators: The government will start identifying individuals who have violated existing norms, which limit land purchases to 250 sqm in non-municipal areas.

Reclaiming Illegally Acquired Land: Land that has been illegally acquired by circumventing regulations will be reclaimed by the state government.

Revisions for Commercial Purposes: In 2017, the permissible land limit for commercial purposes such as tourism, industries, health, and education was increased from 12.5 acres to 30 acres.

However, the government aims to prevent any misuse of this revision.

Addressing Illegal Land Banks: The government has raised concerns about individuals acquiring land under false pretenses, including buying land in the names of relatives or failing to meet the commitments made during purchase.

What Does This Mean for Buyers?

Stricter Scrutiny: Buyers who flout regulations by acquiring land through unethical means will be under stricter scrutiny.

Land Reclamation: Illegally acquired land is at risk of being reclaimed by the government.

Tighter Regulations for Commercial Entities: Businesses seeking land for tourism, health, or educational purposes will face more stringent checks to ensure they comply with the law.
