A nationwide homebuyers' group has proposed the establishment of a specialized unit within the Ministry of Housing to oversee the operations of all state Real Estate Regulatory Authorities (RERAs). This proposal was made during a recent meeting with the Ministry of Housing and Urban Affairs, highlighting concerns about the performance and transparency of state RERAs.
Push for Greater Accountability
The Forum for People’s Collective Efforts (FPCE) stressed the need for a committee to examine the existing infrastructure's effectiveness in ensuring transparency, reliability, and facilitating informed decisions about RERAs. The group pointed out several deficiencies, including non-compliance and continued old practices by RERAs in Maharashtra and Uttar Pradesh, which undermine the transparency goals of RERA and affect homebuyers' ability to make informed decisions.
Critical Evaluation of Regulatory Practices
The FPCE president, Abhay Upadhyay, expressed that the success of RERA heavily relies on the regulatory authorities' commitment to implementing its rules thoroughly. He noted that current regulatory actions seem to be based on individual discretion rather than the RERA Act's guidelines, leading to significant issues like unregulated project modifications and massive litigation risks.
Issues with Current RERA Operations
The FPCE criticized the state-level regulators for not enforcing mandatory updates of quarterly progress reports by developers on RERA websites and for granting unwarranted project extensions. The group also condemned the lack of document verification in the project registration process, calling it a "purely mechanical process.
