MahaRERA Cracks Down on Non-Compliant Developers, Levies Penalties for Absence of QR Codes in Advertisements

The Maharashtra Real Estate Regulatory Authority (MahaRERA) has intensified its regulatory oversight, issuing show-cause notices to 74 developers across Mumbai and Pune for their alleged failure to incorporate QR codes in their project advertisements, a violation of the mandatory requirements established on August 1, 2023.
This stringent measure aims to enhance transparency and protect homebuyers from potential misinformation and fraudulent practices in the real estate sector.
Enhanced Transparency through QR Codes:
MahaRERA mandated the display of QR codes in all promotional activities and advertisements to facilitate immediate access to crucial project details for potential buyers. By scanning the QR codes with their smartphones, homebuyers can swiftly obtain comprehensive information including the developer's name, registration date, anticipated completion date, received approvals, construction status, and any existing complaints or litigations against the project.
This initiative empowers homebuyers to verify any alterations made in the approved plans and the renewal status of the project registration with a single click, fostering informed decision-making.
Penalties and Ongoing Investigations:
Developers found in violation of this mandate are subject to substantial penalties, reaching up to Rs 50,000. Six developers have already been penalized, amounting to a cumulative fine of Rs 2 lakh.
Additionally, 33 more projects are currently under meticulous scrutiny for similar infringements. MahaRERA has been proactive in identifying non-compliance, with 107 projects already under examination for absent QR codes in their advertisements.
High Volume of Non-Compliant Ads:
MahaRERA highlighted the prevalence of such non-compliant advertisements, particularly on online platforms and social media, urging the public to exercise caution. The authority is in the process of dispatching show-cause notices to the remaining developers found in violation of the advertising norms.
