Maharashtra Real Estate Regulatory Authority's New Mandate:
The Maharashtra Real Estate Regulatory Authority (MahaRERA) has intensified its regulatory framework by stipulating that promoters must employ only trained and certified real estate agents. This directive aims to safeguard the interests of homebuyers and uphold the integrity of the real estate sector. Non-compliance could result in the rejection of project registration applications, revocation of existing registrations, or the imposition of penalties on promoters.
Certification Requirements and Compliance Timeline:
In January 2023, MahaRERA issued an order establishing specific timelines for the submission of the MahaRERA real estate agent certificate of competency. Promoters were instructed to ensure that the agents they engage have completed the necessary training and obtained this certification. Although the deadlines were initially extended, MahaRERA has decided that starting from January 1, 2024, no new registrations or renewals for agents will be permitted without this certification. This move highlights the authority's commitment to enhancing the professionalism within the industry.
Importance of Certified Agents & Role of Agents in Protecting Homebuyers:
According to MahaRERA, real estate agents often serve as the primary point of contact for homebuyers, who may be investing their life savings into properties. It is crucial that these agents possess a thorough understanding of RERA regulations, the real estate market, project credibility, land rights validity, RERA-compliant carpet area definitions, commencement certificates, local authority approvals, potential litigation, and the financial standing of developers.
Statistics and Current Agent Certification Landscape:
A MahaRERA official reported that since the authority's inception, there were approximately 44,000 agents registered across the state. However, about 13,000 of these agents did not renew their registration. Despite the requirement for agents to undergo training and certification exams, only about 10,000 have successfully obtained certification to date. This indicates that approximately 20,000 agents still need to complete their training to meet the regulatory standards.
