In a significant ruling, a Mumbai consumer commission has mandated a development firm to compensate a homebuyer, Neela Pawar, with INR 8.5 lakh and refund INR 7.5 lakh due to its failure in acquiring the necessary permits for a redevelopment project in Kandivli. This decision highlights the repercussions of initiating redevelopment without proper authorizations.

The Case

Neela Pawar, who sought to purchase an additional flat in 2011 within the redevelopment project by Zirkon International, was left stranded when the firm terminated the contract, citing construction infeasibilities, and subsequently withheld her payment. The commission found the developer guilty of not securing the required permissions, deceiving Pawar, a senior citizen who had invested her retirement funds.

Commission's Verdict

The commission, acknowledging Pawar's ordeal, awarded her compensation for mental anguish and the harassment endured. It emerged that Pawar, through an RTI inquiry, discovered the developer's failure to obtain construction permissions from relevant authorities, revealing the firm's deliberate omission of crucial information.

Unveiling the Truth

Further investigations revealed that the redevelopment agreement was executed without adhering to the directives issued by the Ministry of Defence regarding construction restrictions on the land. This act of non-disclosure and engaging in redevelopment without the necessary sanctions led to the commission accusing Zirkon International of engaging in unfair practices.
